Fame Finder - Terms and Conditions
  1. Yates's Group Limited of Porter Tun House, 500 Capability Green, Luton, LU1 3LS, is the promoter of the Competition ('the Promoter'). The Competition is a competition to identify and select a female/male singer to become the Fame Finder 2007 National Champion. The Competition will comprise a series of first-round heats ('the Heats'), one local final per participating establishment, ("the Local Finals") eleven (11) regional finals ('the Regional Finals') and one (1) Grand Final ('the Grand Final').
  2. Entry to the Competition is open to all UK residents aged 18 or over, except employees of the Promoter (and/or any of its group companies), their relatives, agents and anyone connected with the organisation of the Competition. Entrants may be asked to provide evidence of identity to prove that they are 18 years of age or over. Evidence will need to comprise an original (not photocopy) driving licence with photograph or original (not photocopy) passport. The Promoter reserves the right to disqualify from the Competition any participant who cannot produce such identification.
  3. The Competition is open to participants of an amateur status only who have neither held a recording contract, nor have been/are not regularly paid for performing. Participants who receive payment for performing no more than once per week, earning no more than £150.00 per week are permitted to enter the Competition.
  4. Every participant must complete a legally binding registration form prior to participation. Registration forms are available and can be completed on-line on the Fame Finder 2007 website, www.YatesFameFinder.com ("The Fame Finder 2007 website"). Participants may alternatively obtain a hard copy of the registration form from a participating Yates's outlet which must be completed and handed to a member of the bar staff prior to participation. In addition and as referred to at paragraph 24, prior to their initial performance on the night of the Heat participants will be required to sign a consent form which deals with any rights arising from their performance.
  5. Only participants who have registered for the Competition on the Fame Finder 2007 website or by hard copy and have signed the consent form will be eligible to proceed to the Local Finals, Regional Finals and the Grand Final, if selected to do so.
  6. Participants may enter an unlimited number of Heats. Once a participant is selected for a Local Final, they may not re-enter any other Heat or Local Final.
  7. Any incomplete, illegible or defaced registration or consent forms will be rejected, and the participant in question will be ineligible to win the Competition. No responsibility shall be accepted by the Promoter for incorrect or incomplete applications or should any participant be unable to perform, due to any circumstances outside of the Promoter's control.
  8. The Competition opens on 13 August 2007. All participants must be registered (whether on line or by hard copy) with the Promoter before the finish time of the Heat they intend to enter. Participants who submit registration or consent forms received after the end of the Heat will be unable to enter or participate in that Heat. The closing date for entries is deemed to be the date of the last Heat, which will take place on or before to the 25th October 2007 which will vary by outlet. Details of the last Heat for each participating outlet will be clearly displayed on the Fame Finder 2007 website and on point of sale material in the outlet.
  9. The Competition will run in selected Yates's outlets. Please see the Fame Finder 2007 website for a list of participating Yates's outlets. Each participating Yates's outlet shall hold a series of Heats during the months of September and October 2007. Details of Heat dates and locations can be found on the Fame Finder 2007 website. During the Heats, participants will be required to sing a minimum of one track from the choices available to them. Two winners will be selected from the each of the Heats held at each of the participating outlets and these winners will then participate in a Local Final. Heat and Local Final winners will also be notified of arrangements for Local and Regional Finals by mail and e-mail.
  10. Following the Heats, the Promoter will hold 11 Regional Finals at venues across the UK during November 2007. The dates and venues of the Regional Finals to be confirmed by the Promoter and listed on the Fame Finder 2007website, once confirmed. A list of the 11 different regions can be found on the Fame Finder 2007website. One winner will be selected from each of the Regional Finals ('the Regional Winners'). The Regional Winners will be announced on the night of each Regional Final as advertised on the Fame Finder 2007 website. Winners will also be notified of arrangements relevant to the Grand Final by mail and e-mail.
  11. In the event of higher or lower levels of participants than expected, the Promoter reserves the right to increase or decrease the amount of Local and Regional Finals to be held.
  12. The Regional Winners will proceed to the Grand Final in London. The Grand Final will be held at Yates's Leicester Square, London on 9th December 2007. The Panel will choose 1 overall winner from the 11 Regional Winners ("the Overall Winner"). The Overall Winner will be announced on the evening of the Grand Final, (9th December 2007).
  13. The Grand Final prize is £10,000 for the Overall Winner. Further details of prizes at local and regional level can be found on the Fame Finder 2007 website.
  14. The Promoter reserves the right to make changes to the format of the Competition. Any changes will be advertised on the Fame Finder 2007 website. The Promoter will also make reasonable efforts to communicate any changes to relevant participants and give them the option of withdrawing from the Competition immediately. The Promoter will give notice of any such changes by e-mail and on the Fame Finder 2007 website.
  15. Participants are not permitted to enter the Competition using their own karaoke discs - they must use the songs available on the in-house system of the participating outlet during the Heats or venue of the relevant Local, Regional or Grand Final or songs, which are available from the karaoke DJ at the relevant venue.
  16. In each of the Local Finals, the Regional Finals and the Grand Final, participants will be judged by a panel of judges ("the Panel"), one of which will be appointed the Chairman - The Panel shall judge the Competition on singing ability, artistic impression, crowd reaction and overall impression. The Panel will be looking for participants who demonstrate originality in their performances and appearance, rather than vocal similarity or similarity in visual appearance to an established artist. The Overall Winner will be the person who, having consistently impressed the Panel by progressing through the rounds is selected by them at the Grand Final.
  17. In the event of a deadlock between the judges forming the Panel, the Chairman will have the casting vote and the Chairman's decision is final.
  18. Decisions of the Panel are final and binding. No correspondence will be entered into between the Panel, the Chairman or the Promoter and any participant(s).
  19. All winning participants in the Heats and subsequent rounds will be notified of the date and venue of the applicable Local, Regional and Grand Final in accordance with paragraphs 9 and 10 above. However, it is the overall responsibility of the participant to ascertain the date and venue of the next stage of the Competition.
  20. The failure by a participant to attend their applicable Heat, Regional Final or the Grand Final or late arrival at the same will result in automatic disqualification from the Competition.
  21. All participants are responsible for making their own travel and accommodation arrangements to and from the Heats, Local Finals and the Regional Finals and the Promoter shall not be responsible or liable for and will not reimburse any travel or other expenses incurred by participants in entering and taking part in the Heats and/or Local or the Regional Finals. The Promoter will be responsible for travel expenses and accommodation for each Regional Winner participating in the Grand Final.
  22. Each participant and the Overall Winner must participate in publicity and promotional activities as requested by the Promoter.
  23. The Promoter will be making audio and video recordings ("Recordings") of parts of the Competition. By and agreeing to these terms and conditions, participants give their consent to the Promoter and its group companies for still and moving images to be taken of them during the Competition by the Promoter or the Promoter's employees, agents or subcontractors ("the Images") and for their name (given name or status name) and the Images to be used generally by the Promoter in any format as required) in any marketing material of the Promoter ("Marketing Material"). The Marketing Material shall include the national and regional press and/or in any product or service created or provided by the Promoter.
  24. By entering this Competition and agreeing to these terms and conditions, participants hereby grant all consents under Part II of the Copyright Designs and Patents Act 1988 to the Promoter in respect of performances given during the Competition at any Yates's outlet. In addition, participants hereby agree to irrevocably and unconditionally waive and assign in favour of the Promoter any moral and performer's rights respectively conferred on them by the Copyright Designs and Patents Act 1988 in relation to any performance given during the Competition at any Yates's outlet. Accordingly participants agree to sign a consent form prior to their performance, which confirms their agreement to this paragraph 24.
  25. No cash or other alternatives are available as a replacement for the prizes offered. Full details of the prizes are available on request. The Promoter reserves the right to change the prizes at any time. Any such changes will be advertised on the Fame Finder 2007 website. The Promoter will also make reasonable efforts to communicate any such changes to relevant participants and give them the option of withdrawing from the Competition immediately by giving notice in writing or by e-mail if desired as a result of the changes made.
  26. If participants contravene any of these conditions, they may be disqualified from the Competition. Should they win a prize(s) and it subsequently be established that they have broken one or more of the conditions, they may be asked to return said prize(s) and reimburse the Promoter accordingly.
  27. The Promoter reserves the right to cancel or amend this Competition, owing to events arising beyond its control.

  29. This Competition and the terms and conditions by which it is governed are subject to the laws of England and Wales.
  30. By entering into this Competition participants acknowledge and agree that their personal data will be retained by the Promoter for the duration of the Competition and for the purposes of running this Competition. The Promoter would also like to retain participants' personal data so that it may communicate with you throughout the duration of this Competition regarding any key dates and venues, for which you may qualify as a participant.
